Parker vs D.C. Gun Control

The Parker vs District of Columbia lawsuit that overturned the D.C. "gun ban" is probably the most watched decision of all times, concerning gun rights. What is most significant is that the lawsuit is the first one ever to have a gun law overturned by citation of the Second Amendment. The D.C. Appeals Court decision in favor of Parker will have massive repercussions across the nation if the Supreme Court refuses to hear it, or better yet if they uphold it.

And of course the D.C. court’s decision in favor of Parker is odious to the Brady Campaign to Prevent Gun Violence. Their contempt for the appeals court decision is spelled out in a written critique that can be read in it’s entirety on the Brady web site. But if you don’t want to read all the nauseating diatribe, I will comment briefly on it here.

For all of the legalese in the Brady Center commentary called Second Amendment Fantasy it falls far short of being convincing. Because the whole issue is, and has always been what the Second Amendment to the Constitution refers to; individual rights, or the collective rights of a military organization. And whether the Supreme Court rules against the Parker decision or whatever legal drivel the Brady Bunch critiques it with, the Bill of Rights deals only with individual rights, not collective government rights. And it is here in this one amendment that gun control twinks would have us believe that the B.O.R. refers to collective rights, instead of individual rights. It is well known that the Bill of Rights was established in response to what had been oppressive British rule that was undone by the men and boys recruited from their homes with their personal firearms to form the “militias” that became the U.S. military of the time.

In their critique the Brady legal team, also takes issue with the word bear, as in to “keep and bear arms” making the ridiculous case that bear does not mean to carry or keep on your person. That argument kind of reminds me of the statement by one of the great gun control advocates of our time when he said, "It depends on what the meaning of the word 'is' is." What I have found in my lifetime is that anybody on opposing sides of an issue can make up a convincing argument for or against any issue to appeal to anyone who does not make use of their own mind and research to decide what is right or wrong.

And that is exactly what the Brady Bunch depends on with the gun-control public, ignorance and emotion. If it “feels” like it’s right, it must be. Reason and facts have no bearing on the case. But the good news is that across the country, gun rights, including the right to carry concealed firearms are becoming stronger and stronger as law abiding citizens get sick of being government controlled victims. And my belief is, that in general, the majority of American people are smart enough to see through the emotionalism and deception of the Brady Campaign, and strong enough to continue to strengthen their rights nation-wide.
